GENERAL CONDITIONS OF SALE

The following general terms and conditions of sale govern commercial relations between Azienda Agricola Montinaro Pompilio, with registered office in Campi Salentina (LE), via Medaglie d'Oro n. 55 - R.E.A. 203275 – VAT number 00255810756 (hereinafter referred to as the "Seller") and the author of the order for the movable property offered for sale on the website www.terredellolmo.it (hereinafter referred to as the "website") and are an integral part of the contracts concluded between the Seller and the customers (hereinafter referred to as the "Buyer"). The Buyer who accesses the site to make the purchase of goods, accepts and is bound by the general conditions of sale (GCS) as they appear when accessing the site. The Seller reserves the right to make changes to these conditions at any time with non-retroactive effect. These General Conditions of Sale may be subject to any modification necessary by subsequent legal provisions. Any condition formulated by the Buyer that does not comply with these GCS shall be considered invalid.

ORDER

The order is completed by filling in the registration form on the site following the procedures indicated therein, or by the alternative methods indicated below, which include the mandatory acknowledgement and acceptance of these conditions.In addition to the purchase through the Internet, it is also possible to order by e-mail: by writing to This email address is being protected from spambots. In any case, orders will be followed by an email confirming or rejecting the order by the Seller to the Buyer.The contract stipulated between the company Montinaro Pompilio and the Buyer must be considered concluded with the acceptance, even partial, of the order by the company Montinaro Pompilio. By placing an order in the various ways provided, the Buyer declares to have read and accepted in full all the information provided to him during the purchase procedure, the offer of product specifications, and these GCS in their entirety.

The Purchaser declares that he has not entered false or fanciful data in the order form and therefore declares that the data entered correspond to his real personal data. The company Montinaro Pompilio reserves the right to accept only orders from persons in possession of Tax Code and/or VAT number (or equivalent if not resident in Italy) and who have reached the age of majority.The Montinaro Pompilio company reserves the right to refuse the order also in the following cases: shipments to P.O. boxes; supply of incorrect or untrue personal data; previous non-fulfilment for any reason; registration in the list of protests; submission to bankruptcy proceedings; lack of availability of the goods, for any reason, in its own warehouses.

The company Montinaro Pompilio reserves the right to pursue any violation and abuse in the appropriate courts. The obligations assumed by the Buyer in this article, as well as the guarantee of the receipt of the payment, are essential for the Montinaro Pompilio company which reserves the right, in case of non-fulfilment of one of the above mentioned obligations, to terminate the contract, without prejudice to any right to compensation for damages. Any right of the Buyer to damages or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial, of an order.

AVAILABILITY OF PRODUCTS

The availability of the products must be understood as referring to the exact moment in which the Montinaro Pompilio company receives and examines the order. In case of unavailability of the products or of insufficient availability compared to the request, the Seller will inform the Buyer by e-mail of the reduced availability of the requested goods or the new delivery times foreseen for the requested quantities, asking the Buyer whether he intends to confirm the order or not. If this is not the case, the entire amount paid will be returned to the Purchaser.

PRICES

The prices indicated on the site are INCLUSIVE OF VAT and EXCLUDING TRANSPORT COSTS which will be automatically added when completing the order, depending on the weight of the package and the place of delivery.

 The Seller reserves the right to change the prices of the goods on sale at any time. The products will be invoiced at the price in force at the time when the order is sent.

TERMS OF PAYMENT

For the purchase of goods for sale on the site, buyers may make payments by credit card, PayPal or by bank transfer in advance. THE SELLER RESERVES THE RIGHT NOT TO ACCEPT CREDIT CARD PAYMENTS IF, AT ITS SOLE DISCRETION, HE DEEMS IT APPROPRIATE. In the case of payment by bank transfer, the Purchaser must indicate it when ordering. In this case, the goods will be shipped after the amount has been credited to the Seller's bank account.

Important: for all forms of advance payment, before making the payment, the Buyer must wait for the e-mail confirmation of availability of the ordered goods where the data will be reported to make the bank transfer. If requested by the Purchaser and expressly accepted by the Seller, the payment can also be made by cash on delivery to the shipper, but in this case, a surcharge equal to 2% of the total amount will be applied, with a minimum charge of € 3.50.

DELIVERY TERMS

The Montinaro Pompilio company reserves two working days to carry out all the necessary goods preparation, packaging and administrative procedures. For deliveries, the Seller relies on a courier and undertakes to deliver the purchased goods to the address indicated by the Buyer in a period of 72 / 96 non-working hours starting from the date of delivery to the courier (only for shipments within the national territory). These delivery times may, however, be subject to change due to force majeure beyond the Seller's control, traffic conditions, road conditions or the intervention of any authority. Any delivery time is not binding for the Seller, unless otherwise agreed in writing, in which case the delivery date will be specified in the order confirmation but the Seller will in any case be exonerated from any responsibility in case of impossibility to respect the terms due to force majeure or other unforeseeable events. DELIVERY WILL BE MADE ON THE STREET LEVEL.

In order to optimize the delivery process, the address indicated by the Buyer must be an address to which delivery can be made during normal business hours. Alternatively, the buyer may request, at no additional cost, the delivery "at the deposit", in this case it will be his care to go to the nearest deposit of the courier, indicated in the order confirmation, to collect the purchased goods. The relevant fiscal document will be attached to each shipment.

Upon delivery of the purchased goods the buyer must:

- check the quantity and packaging of the products and note any objection on the delivery note;

- check the conformity of the purchased goods with what is indicated in the order confirmation received and specify any discrepancies in the delivery note;

- inform the Seller as soon as possible, at the latest within 48 hours after delivery, of any anomalies found and to write them down on the delivery note of the express courier.

FREIGHT COSTS

Transport costs are calculated automatically based on the weight and shipping address and are vali for the entire national territory, EXCLUDING THE ITALIAN ISLANDS AND VENICE, for which the company Montinaro Pompilio reserves the right to communicate any additional shipping costs that must be expressly accepted by the buyer. For shipments abroad, the Seller reserves the right to communicate to the Buyer the supplement to be paid IN WRITTEN FORM in the confirmation email which will vary according to the total weight of the packages and the country where the shipment is destined. THE MAXIMUM WEIGHT FOR EACH SINGLE SHIPMENT ABROAD IS EQUAL TO KG. 45 unless otherwise agreed, ratified in writing, between the Buyer and the Seller.

All buyers will be notified, by the same means used to place the order, of the shipment of the goods and they will be given the code necessary to monitor the shipment on the website of the courier used. For international shipments an additional fee will be charged, to be added to the cost of the order, which will be due and calculated according to the country of destination, even if the customer is entitled to free shipping. Products intended for buyers residing in non-EU countries an additional 20 € will be charged due for the issuance of the necessary "certificate of origin" by the Chamber of Commerce of Lecce. In accordance with Article 1327 paragraph I of the Civil Code, the goods travel exclusively at the customer's risk. It is the Buyer's right to request INSURANCE COVERAGE for the packages to be shipped at the time of ordering, it is the Seller's obligation to communicate in writing in the confirmation email the surcharge due for this additional service. The buyers are allowed to collect their orders from our office, agreeing the date for collection.

RIGHT OF WITHDRAWAL

Pursuant to Legislative Decree no. 206 of 06/09/2005, the Purchaser has the right to withdraw, totally or partially, from the contract and return INTACT goods purchased to the following address: Azienda Agricola "Terre dell'Olmo" di Montinaro Pompilio: s.p. 309 (vecchia Campi-Salice), località "Olmo" s.n.c. - 73012 Campi Salentina (LE). The right of withdrawal applies only to consumers, meaning as such the buyer who has purchased as a natural person, therefore for personal use unrelated to his work, business or professional activity. Buyers who make the purchase for purposes related to their professional activity, i.e. who place the order indicating their VAT number, will not be considered as consumers. The buyer as defined above has the right to withdraw from the contract, without any penalty and without the obligation to specify the reason, within 14 calendar days from the date of delivery of the product (withdrawal period). The communication regarding the exercise of the right of withdrawal must be sent by the Purchaser before the expiry of the withdrawal period.

Once this communication has been made, the purchased goods must be returned intact to the Seller within 48 hours of the communication. In any case, the postmark or the document of acceptance of the forwarder will be considered as proof. The goods must be returned intact in their original packaging, complete in every part and with the attached fiscal documentation. As provided by Legislative Decree no. 206/2005 and art. 55 of the Consumer Code, the right of withdrawal does not apply to goods made on demand or clearly personalized. The buyer will be refunded in full and without penalty for the amounts paid, remaining at his expense, exclusively, any original shipping costs and those for the return of the goods.

The right of withdrawal in particular is subject to the following conditions: 1) the purchased goods must be intact, unused and returned in their original packaging, complete in all its parts (including packaging, any documentation and accessory equipment); 2) the shipment costs, until the receipt at our warehouse, is at the buyer's expense and under his full responsibility. In the event of damage to the goods during transport, the Montinaro Pompilio company will notify the buyer of the incident within 5 days of receipt of the goods at its warehouse, to allow him to file a timely complaint against the chosen courier and obtain a reimbursement of the value of the goods (if insured). In this case, the product will be made available to the purchaser for its return and the request for withdrawal will be cancelled at the same time.

The Montinaro Pompilio company is not liable in any way for damage or theft/loss of goods traveling with uninsured shipments; upon arrival at the warehouse, the product will be examined to assess any damage or tampering not resulting from transport. Should the packaging and/or the original packaging be damaged, the Montinaro Pompilio company will deduct from the refund due a percentage, not exceeding 10% of the same, as a contribution to the costs necessary for restoration; if the Montinaro Pompilio company has collected the price of the product from which it withdraws, it will reimburse the buyer the relative amount (minus any sums for the restoration of the packaging), by bank transfer, within 30 days from the date of notification of withdrawal by registered letter and not before receiving the product. It will be the buyer's responsibility to promptly provide the bank details (SWIFT code – IBAN code account number of the owner of the order) on which to receive the transfer.

TREATMENT OF PERSONAL DATA

The Montinaro Pompilio company guarantees its purchasers the respect of the regulations regarding the treatment of personal data, according to the provisions of the privacy code of Law decree n. 196/2003. The data controller is Mr. Montinaro Pompilio.

CURRENT LEGISLATION

The sales contract between the Buyer and the Montinaro Pompilio company is concluded in Italy and governed by Italian law. For any civil and / or criminal dispute arising from the conclusion of this contract of sale at a distance, the competent court will be that of the municipality of residence or domicile of the owner of the company Montinaro Pompilio.
